The VAT exemption on service exports is one of the most valuable tax benefits for a Colombian SME selling to foreign clients, and one of the most often lost through documentation errors. Charging VAT to a foreign client can make the service uncompetitive, while invoicing at 0% without meeting the requirements exposes the company to an assessment by the tax authority. This guide explains when the 0% exemption applies and how to prove it.

At Soulbit Academy we have already explained invoicing in dollars from Colombia and how the Simple Tax Regime treats foreign income. Here we go one step further: the requirements of Article 481 of the Colombian Tax Code (Estatuto Tributario), the records worth keeping and the refund of balances in favor.

Colombia service exports and VAT: what Article 481 says

A service export is VAT exempt when the service is rendered in Colombia and used exclusively abroad by companies or persons with no business or activities in the country. That is the rule in paragraph (c) of Article 481 of the Estatuto Tributario, which also gives these services the right to a bimonthly refund of the VAT paid on purchases.

An exempt operation is not the same as an excluded one. In an exempt sale the rate is 0%: the client pays no VAT, but the company keeps the right to credit the VAT on what it buys to deliver the service. That difference is what opens the door to a refund.

Article 481 also contains a separate paragraph for audiovisual works and software protected by copyright, regulated by Decree 456 of 2021 with its own requirements. This guide covers the general rule in paragraph (c), not that special case. A company that develops software or produces audiovisual content for a foreign client should confirm with its accountant which treatment applies.

The implementing rules sit in the Single Tax Regulatory Decree 1625 of 2016 and in Decree 1080 of 2015. Article numbers have changed across compilations, so always cite the version your adviser confirms as current.

The three substantive conditions for VAT exemption

A service is exempt when it meets three cumulative conditions, under paragraph (c) of Article 481 and the tax authority's criteria. First, the service is rendered in Colombia. Second, it is used exclusively abroad. Third, the beneficiary has no business or activities in Colombia.

Exclusive use abroad is the most contested condition. A design service delivered to a client in Miami who uses it for a campaign in the United States clearly qualifies. A service whose result is also exploited in Colombia, even partly, may lose the exemption and become taxable.

What happens if the foreign client has a Colombian subsidiary?

In Ruling 15981 of 2026, DIAN clarified that an economic link to a Colombian affiliate does not automatically prevent the exemption. It can apply when the foreign contracting entity directly and exclusively benefits from the service abroad. If a Colombian subsidiary or branch uses or benefits from the result, even partly, the exclusive-use condition fails. A service contracted directly for a Colombian entity is a different case. Document the actual beneficiary and place of use, beyond the invoice recipient.

Table 1 summarizes how common cases are assessed.

Formal requirements: RUT, invoice and supporting records

Beyond the substantive conditions, the provider must meet formal requirements that prove the operation to the tax authority. The first is registration in the RUT as a service exporter. DIAN Concept 8660 of 2024 states it in its analysis of Article 2.10.2.6.12 of Decree 1080 of 2015.

The second requirement is to invoice the operation. The electronic sales invoice should identify the foreign client and the value of the service, and show VAT at 0% as an exempt operation. Invoicing without VAT while the RUT is incomplete is the most frequent error and the one that exposes a company most in a review.

The third requirement is to keep the documents proving the operation exists. Article 481 obliges service exporters to keep those records, and the regulation accepts, among others, a copy of the contract between the parties or of the commercial offer or quotation with its acceptance. A written contract is the strongest proof, although the general rule does not make it the only option.

A file per operation usually holds:

  • The contract, or the commercial offer or quotation with its acceptance.
  • The electronic sales invoice identifying the foreign client.
  • The deliverables or other evidence that the service was rendered.
  • A statement or evidence that the client uses the service only abroad.
  • The proof of payment, with date, amount and counterparty.

Is a written contract mandatory to export services without VAT?

Paragraph (c) of Article 481 requires keeping the documents that prove the operation, and the regulation mentions the contract or an accepted offer and quotation. We did not find in the sources consulted a general obligation to have a written contract, but a clear contract makes proof easier if the tax authority reviews the file. Confirm the standard for your activity with your accountant.

Foreign exchange channeling and collecting from abroad

Collecting a service export has its own foreign exchange layer, separate from the tax layer. That a service is VAT exempt says nothing about how the payment must enter the country or whether an exchange declaration is needed. Colombian foreign exchange rules depend on the type of operation and the channel through which funds arrive.

To understand which service operations must be channeled through the exchange market and which may be handled otherwise, the guide to the Colombian foreign exchange regime for companies is the starting point. It explains the role of the central bank and the tax authority.

Consistency between records matters. The invoice, the contract and the payment must tell the same story: same client, same amount and roughly the same date. A mismatch between the client named on the invoice and the payer on the receipt tends to raise questions in a review.

VAT refunds and offsets for balances in favor

An exempt service exporter can end up with a VAT balance in its favor, because it charges no tax on sales yet pays VAT on purchases. Article 481 provides a bimonthly refund for these services, meaning the balance can be requested every two months instead of waiting for year end. The balance may also be carried into later returns or offset, under the rules set by the tax authority.

An illustrative example, with assumed amounts that do not describe any real company. A consultancy bills a foreign client 20,000 dollars a month and buys local services carrying creditable VAT of 3,000,000 pesos in the two-month period. Because its sales are exempt, that 3,000,000 has nothing to be credited against and becomes a balance in its favor. It can request a refund by filing the application with the required records.

The application requirements are in Article 1.6.1.21.15 of Decree 1625 of 2016, as amended by Decree 456 of 2021. For the case in the paragraph of Article 481, the regulation requires, among other things, a copy of the contract with the foreign buyer and a schedule of creditable taxes certified by a statutory auditor or public accountant. For the general case, review the full current text with your accountant.

Four practical habits help an exporter:

  • Track creditable VAT per two-month period, not only at year end.
  • Check that each purchase invoice meets the requirements to be creditable.
  • Keep the certified schedule of taxes that generated the balance.
  • Build the refund request into the tax calendar.

Table 2 compares the three treatments an accountant must tell apart.

Common mistakes that cost the exemption

The exemption is usually lost through documentation failures, not because of the nature of the service. The first mistake is invoicing without VAT with an incomplete RUT, lacking the service exporter responsibility. The second is failing to prove the service was used exclusively abroad.

The third mistake is mixing on one invoice services used in Colombia and services used abroad without separating the values. The fourth is not keeping the contract or accepted offer, and the fifth is requesting a refund without the certified schedule of creditable taxes.

A sixth mistake is assuming the tax regime changes the rule. Neither the Simple Regime nor the ordinary regime alters the Article 481 exemption; each treats income tax and local business tax differently, as the guide to the Simple Regime and service exports explains.

To see how all of this fits in a complete operation, read the case of a Colombian software factory billing US clients.

What Soulbit does in the collection and what stays with the company

Soulbit does not issue invoices, calculate or file VAT, or certify that a service is an export. Those tasks belong to the company and its accountant. Whether a service qualifies as exempt depends on its nature and the records the tax authority requires, not on the channel used to get paid.

What Soulbit V1 does provide is the operational layer of the collection. A Colombian company with KYB verification can collect from a foreign client through a payment link or a collection QR, hold the balance in USDC or USDT under institutional custody with MPC, and convert it to pesos through eOTC conversion by quote, paid out over local Colombian bank rails. Each movement is recorded with date, amount and counterparty, which helps match the payment to the invoice.

Support is human.

Frequently asked questions

What VAT rate applies to service exports from Colombia?

A qualifying export under Article 481(c) of the Colombian Tax Code is VAT exempt at a 0% rate, with the right to credit eligible input VAT. The service must be rendered in Colombia and used exclusively abroad by its foreign beneficiary. Economic ties to a Colombian affiliate alone do not remove the exemption; use or benefit in Colombia can.

What is the difference between an exempt and an excluded service?

An exempt service is taxed at a 0% rate, so the provider can credit the VAT paid on its purchases and request a refund. An excluded service generates no VAT and gives no right to credit input VAT. The service export in Article 481 is an exempt operation, which is why exporters can claim balances in their favor.

Does a service exporter need a specific RUT registration?

Yes. The tax authority (DIAN) has stated that the provider must be registered in the RUT as a service exporter, under Article 2.10.2.6.12 of Decree 1080 of 2015. In a 2024 ruling it added that the RUT may require other responsibilities depending on the taxpayer, so the full list should be reviewed with an accountant.

How often can a service exporter request a VAT refund?

Article 481 provides for a bimonthly refund of VAT balances arising from the exempt services in paragraph (c). The exporter can build up a balance in favor each two-month period and request a refund or offset it against other obligations, under the rules in force.

Can a Colombian company collect a service export in USDC and keep the exemption?

The exemption depends on the nature of the service and its supporting records, not on the payment method. A Colombian company paid in USDC or dollars must still invoice and document the operation in the same way. It should confirm the foreign exchange and accounting treatment of the payment with its accountant.
